1. INTRODUCTION AND TERMS

These Terms and Conditions (hereinafter referred to as "Terms and Conditions") govern the contractual relationship between the Provider, which is RoomBet s.r.o, IČO: 11856106, with its registered office at Na Folimance 2155/15, Vinohrady, 120 00 Prague 2, registered in the Commercial Register kept at the Municipal Court in Prague, Section C, Insert 355438 (hereinafter referred to as the "Provider") and the Customer, resp. the user (hereinafter referred to as the "User") of the Provider's services consisting in enabling the use of the Provider's web application aimed at the management of selected tournaments and matches in which the User may actively participate through his/her picks regarding the results of predetermined tournaments and matches (hereinafter referred to as the "Services").


The Services will be made available to the User through remote communication means via the interface of the Provider's website and phone application, which are available at https://www.funrivals.com (the "Website") and the official system store on the phone (the "FunRivals" application).


The Terms and Conditions govern the mutual rights and obligations of the parties arising in connection with or pursuant to the contract under which the User will be allowed to use the Provider's web application and to actively participate in the online tipping tournament created by the Provider (hereinafter referred to as the "Contract").

The Contract is concluded between the Provider and the User who is a natural person not acting in the course of his/her business or profession or a person who is an entrepreneur.

The Parties acknowledge that the Provider's services are not of a gaming or gambling nature, as the Provider does not organise or otherwise provide gambling on its website, as the Services do not allow Users to place any bets or provide any monetary or non-monetary prizes.

By registering the User to the Provider's web application, the User acknowledges that he/she has duly read these Terms and Conditions and that he/she accepts them without reservation. The User shall be sufficiently notified of these terms and conditions prior to the actual conclusion of the contract and shall have the opportunity to familiarise himself with them on the Provider's website prior to the conclusion of the contract between the User and the Provider. These terms and conditions form an integral part of the contractual relationship between the provider and the user.

The Provider's services are generally intended for persons over 15 years of age. Younger persons are allowed to participate only with the prior consent of their legal representatives.

These Terms and Conditions are available on the Provider's website. The Provider may unilaterally change or amend the wording of these Terms and Conditions. This provision does not affect the rights and obligations arising during the validity of the previous version of the terms and conditions.

If the user is a consumer, the relations not regulated by these terms and conditions are governed by the Civil Code, i.e. Act No. 89/2012 Coll., Civil Code, as amended (hereinafter referred to as "CC") and the Consumer Protection Act, i.e. Act No. 634/1992 Coll., Consumer Protection Act, as amended (hereinafter referred to as "CPC").

 

2. USER REGISTRATION AND USER ACCOUNT

If the user wishes to use the Provider's Services, it is necessary to create an account on the Provider's website, or mobile application, through free registration, by which he/she also agrees to these Terms and Conditions, which he/she is obliged to get properly acquainted with before the registration itself and, therefore, the conclusion of the contract.


On the basis of the user's registration made on the provider's website, the user can access his/her user account. From his/her user account, the User can use the Services offered by the Provider, as well as order and pay for selected Services.


To register, the User must fill in the registration form correctly, completely and truthfully, containing at least the following information: first and last name, email address, chosen password and chosen username. If the Provider suspects that the information provided by the User as part of the registration process is false, incomplete or misrepresented, the Provider shall be entitled to block or cancel the User's account.


The user is obliged to set a sufficiently secure access password. The user must not use a derogatory term as his/her username. The User is obliged to protect his/her login data, to keep it secret and not to disclose it to third parties. The user is therefore obliged to maintain confidentiality regarding the information necessary to access his/her user account. The Provider shall not be held liable for any misuse of the access data or the account created by the User caused by a third party or the User. Any misuse of a user's account must be reported by the user to the provider.


The user is not entitled to allow third parties to use the user account. In the event of a breach of this obligation, the user shall bear all liability for actions taken through this user account.


The user is allowed to obtain a new password in the event of loss of the original login password. To obtain a new password, it is necessary to use the "Forgotten Password" function, which is located on the provider's website.


The User understands and agrees that the User's username, as well as other data and profile picture and content related to the operation of the User's account, such as participation in individual competitions or tournaments, specific User's picks and other related information entered by the User, will be publicly accessible to all visitors to the Provider's website or other users of the Services, i.e. this information will not be kept confidential. The User also grants the Provider a non-exclusive, transferable, locally unrestricted and time-limited right to use the information and data entered by the User when creating or operating the User Account, in particular the User Name, as well as other content located within the User Account. With respect to the foregoing, the User hereby grants the Provider a worldwide, transferable, royalty-free license and right to host, store, use, copy, display, reproduce, edit, publish, modify and distribute the information that the User submits, uploads, displays or otherwise makes available through the Web Application or the User's account.


User acknowledges that User's account may not be available on a continuous basis, particularly with respect to necessary maintenance of Provider's hardware and software equipment or necessary maintenance of third party hardware and software equipment.


The Provider may require a change of the username for any reason, especially in cases where it has doubts about its suitability. The Provider may cancel the user account, in particular if the user no longer uses his/her user account, but at least for 1 year, or if the user violates his/her obligations under the contract, terms and conditions or other documents governing the relationship between the Provider and the user.


3. PROHIBITED CONTENT

The User shall not violate any law, contract, intellectual property right or other right of a third party and shall not commit any tort and acknowledges that he/she is solely responsible for his/her conduct while using the Provider's services.


By using Provider's Services, User agrees to comply with these Terms of Service and Provider's Community Policy and not to:


1. create, upload, transmit, distribute, or store any content that is inaccurate, illegal, copyright infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;


2. impersonate any person or entity, falsely claim to be affiliated with any person or entity, access the accounts of others on the Provider Services without authorization, misrepresent the source, identity or content of information transmitted through the Provider Services, or engage in any other similar fraudulent activity;


3. defame, harass, abuse, threaten or defraud users of the Provider's services or collect or attempt to collect personal information about users or third parties without their consent;


4. interfere with or impair in any way the operation of the Provider's services or the use of the Provider's services by any user, including uploading or otherwise distributing viruses, adware, spyware or other malicious code;


5. use or attempt to use another user's account without that user's and provider's permission;


6. attempt to circumvent any content filtering techniques we use or attempt to access any service or area of the Provider's services that you are not authorized to access;


7. use Provider's services for any unlawful purpose or in violation of any local, state, national or international law or regulation, including but not limited to laws governing intellectual property and other proprietary rights, data protection and privacy.


To the extent permitted by applicable law, Provider shall not be liable for any User Content or for any loss or damage arising therefrom, nor shall Provider be liable for any errors, defamation, libel, slander, omissions, untruths, obscenity, pornography or profanity User may encounter while using Provider's services. The User uses the Provider's services at his/her own risk. In addition, this policy does not create any third party privacy claim or reasonable expectation that the Provider Services will not contain any content that is prohibited by this policy.


The Provider is not responsible for any statements or representations contained in the User Content. The Provider does not endorse any User Content, opinion, recommendation or advice expressed therein and expressly disclaims any liability in connection with the User Content. The Provider reserves the right to remove, review or edit any User Content posted at any time and without notice, even if such User Content violates these Terms and Conditions or applicable law. Any use of the Provider's Services in violation of the foregoing violates these Terms and Conditions and may result in, among other things, termination or suspension of the User's rights to use the Provider's Services.


4. CONTENT OF THE PROVIDER'S SERVICES

The content of the services offered by the Provider to the Users is the possibility to participate with other Users in a so-called tipping competition, through which individual Users will be able to enter their tips on the results or other statistical data of pre-selected tournaments and competitions into the Provider's web application. The Provider shall enable the Users within its web application to clearly evaluate the results of matches and other competitions, to convert these results into points for individual Users and to rank the User in relation to other Users participating in the joint tournament or competition.


The Provider offers a wide range of options within its web application, where the exact designation of individual tournaments and matches, their description and the permitted method of scoring, including other information, is provided on the Provider's website.


The Provider is not obliged to provide specific content via the web application and is therefore entitled to remove, otherwise modify or change certain tournaments or matches, as well as to modify their terms and conditions and other content in any way without prior notice. The Provider shall not be liable for any damages caused to users or any third parties for this reason. The Provider may make such changes or modifications without any prior notice to the User.


The position in the ranking is determined by the following criteria in the given order:
1. Total points
2. Number of accurate tickets
3. Number of tickets with a score difference
4. Number of correct picks of the winner
5. Number of points for goals scored by the tipped scorers

Within its web application, the provider distinguishes between the different tournaments, which will be classified in the following way:

1. Main tournament;
2. Side tournaments;

Both types of tournaments have the option to turn on a card game mode, which can further affect the points earned.


Main Tournaments are announced in five prize categories (A, B, C, D, E, F). Each user is allowed to play only one main or side tournament at a time. Multiple tournaments falling under the consumer competitions (B,C,D,E,F) can be played at the same time.


Main Tournament
Within the framework of the so-called main tournament, the provider will create the entire tournament, especially with regard to currently held international or national tournaments (e.g. Ice Hockey World Championship, FIFA World Cup, Australian Open, etc.). The choice of tournaments depends solely on the choice of the provider. The Provider determines the time by which the User must fill in his/her picks within the selected tournament, the scoring method, the start and end of the tournament, the individual scheduled matches within the tournament for which the User can subsequently enter his/her individual picks.
The user can participate in this tournament by creating a clone of the tournament created by the provider, which can be marked with its own name. Such a user-created tournament may be accessible only to a select group of other users, or the user may create a public tournament that can be participated in by the general public, i.e. any other user of the web application. Within a user-created clone of a tournament, set matches cannot be changed.
However, the user can change the scoring method at his/her choice.


Side tournament
Within the so-called side tournament, the provider will publish individual tournaments currently taking place within its web application, the selection of which will depend solely on the user's choice (e.g. First Czech Football League, Premiere League, etc.). The Provider shall determine the start and end of the tournament and the individual scheduled matches within the tournament.
The user can create his/her own tournament from the tournaments created by the provider by selecting specific matches to be made available in the web application for his/her own tournament. The user can combine matches from different tournaments into his/her tournament. The user marks his/her tournament with his/her own name.
A tournament created by the user in this way can only be accessible to a selected group of other users who will be invited to the tournament by the user who created it. The user chooses a specific scoring method within the tournament created at his/her discretion.
Results and scoring


The Provider's web and mobile application will allow the User to automatically evaluate the individual User's picks for specific matches and recalculate the individual User's points according to the way they are set up in the tournament, the classification of which is set out below in these Terms and Conditions. Each player can then view their current ranking in the tournament to see how each player is doing in the "success of their picks" ranking compared to other users participating in the tournament.


The match evaluation and scoring only apply to the regular playing time of the game; any overtime or extra time is not counted. However, goal scorers are recorded based on the official tournament statistics (e.g., according to IIHF rules in hockey, goals scored in overtime are included).


The results and predictions of each user will be visible to other users and tournament participants.


A match may be cancelled if a user's pick cannot be evaluated. For example, the opponent has not entered due to injury, the match has been officially cancelled, etc. In this case the match will not be scored in the application. If the match ends in a disqualification or a forfeit, and officially in a given match this means a specific result, such a result is counted as a result and evaluated, thus points are counted.


Match types (betting and scoring)

The web application allows the user to make their picks within a specific tournament or match in the following ways:

1) VERSE
This method of picking will allow the user to select the winner within a specific match (e.g. within a hockey match the user will be able to determine which of the teams they expect to win). In this type of match, the user will earn points for correct guesses about the early teams in the match or for correct guesses about the outcome of the match or the winner.

2) YES/NO
This type of tipping will allow the user to choose his/her guess regarding the truth of a predetermined statement regarding a specific match (e.g. in a hockey match, a predetermined statement will be that a specific player (e.g. Jaromir Jagr) will score a goal in the hockey match). Within this type of match, the user will earn points for a correct guess as to the outcome, whether or not the claim is valid and matches the user's guess.

3) EXACT
This type of picking will allow the user to choose their exact pick regarding a predetermined fact (e.g. Luis Habiston finishes second in the Monaco Grand Prix, Martin Novak misses 3 targets in the biathlon race). In this type of match, the user will earn points for a correct guess regarding the exact outcome of a given fact.

4) SHOOTER
This type of picking will allow the user to choose his/her pick regarding the best or most outstanding persons within the match (e.g. in the Ice Hockey World Championship tournament, out of 100 possible shooters, the user will choose the top 5 shooters by scoring a defined number of points for each goal scored by his/her shooters). In this type of match, the user will earn points for a correct guess on each goal scored by his designated shooter.

5) PLACING
This type of tipping will allow the user to choose, for example, the overall winner of the tournament (e.g. the Czech Republic team will win the hockey championship). In this type of match, the user will earn points for accurately determining the location offered.

6) WINNER
This picking method will allow the user to select the winner from two opponents. Unlike the VERZUS type, this does not determine how many points/goals etc. the opponent will get, it only determines who will win the match (e.g. in a boxing match the home challenger will win).


Sub-matches A match for betting can also have tied sub-matches. For example, in a boxing match, we can include in the sub-matches picks in which round the match will end and how the match will end. If they are YES/NO picks, they can be mutually exclusive (e.g. you cannot pick a win in round 1 and 2 at the same time). Points for such YES/NO picks are awarded only if the user also correctly hit their parent match. In our case he correctly picked the winner of the boxing match. Then if he missed the winner, he cannot get points for subfights of YES/NO type, even if he hit correctly the round in which the fight will end.


Game mode and cards


In a tournament with Game Mode enabled, each player will receive cards before the tournament begins that have unique effects that will affect their score.

There are 8 cards, some of which can be placed on your own picks and some on your opponents' picks. Some of the more powerful cards can only be used by the user after another card has been used.


A complete deck of cards is always dealt (cards can be selected by the administrator of the tournament), and the number of decks players receive is calculated as an integer ratio of the number of matches in the tournament / 4*(cards count). In most tournaments, this means that you can influence at most a quarter of the picks with your cards.


a) ENEMY

This card causes a deduction of the points earned (according to the points setting for the winner's pick)


b) FREEZER

This card causes zero points to be scored if the user has not used the 'Saver' card


c) FRIENDLY

This card causes double points gain. Use of this card unlocks the 'Saver' card


d) JOKER

This card causes a bonus point gain (depending on the points setting for the winner's ticket). Using this card unlocks the 'Freezer' card


e) LUCKER

This card causes a bonus point gain (depending on the points setting for the winner's ticket)


f) MULTI

This card causes a double point gain.


g) SAVER

This card cancels all negative cards played for the match


h) SPY

This card allows you to see the picks and cards played by others for this match even before the match has started


i) SWAPPER

This card swaps the home and away scores of the selected tip


j) REPLACER

This card swaps my tip with the opponent’s if my tip was incorrect


k) RESET

This card adds the opponent’s earned points to my points (excluding the effects of cards on the opponent’s tip).


l) THIEF

5. Consumer competitions

The Operator may, at its sole discretion, announce a consumer competition during any of the Tournaments. The fact that a consumer competition is announced during the tournament will be indicated in the tournament description. By participating in the tournament, the user agrees to its rules.

Participation in the competition is not conditional on the purchase of any services or the payment of any other entry into the competition.

Competition mechanics

The evaluation criterion for the competition is the success rate in the tournament in question. In case of a tie, the operator will decide the ranking. The evaluation of the competition will be made by the operator within seven days after the end of the tournament. The winner will be contacted to tell where the prizes will be sent.

There is no legal entitlement to win any prize in this competition. Prizes cannot be cashed or claimed in exchange for other goods. In the event of delivery of prizes by ordinary postal or similar means within the Czech Republic, the operator will be responsible for the cost of delivery.

The Operator reserves the right to change, cancel or otherwise modify the competition and prizes at any time during the competition. The rules of the competition may be changed or amended during the course of the competition. The Contest Operator shall not be liable for any damages or any pecuniary or non-pecuniary loss caused by participation in the Contest or the prizes in the Contest or in connection therewith. Neither the Promoter nor the Competition Operator shall be liable for any loss, non-delivery, delay or damage to any prize in the event of transportation by post.


6. PRICE OF PAID SERVICES AND PAYMENT TERMS

The user acknowledges that, in addition to the free services—which include the free registration of the user and access to the provider's web and mobile applications —the provider also offers its services as paid, in cases where the user wishes to actively participate in a tournament or competition. In such cases, the user is required to pay the specified fee to the provider.


Active participation refers to the use of services without the display of advertisements. The valid price for concluding a service agreement is the one listed on the provider’s website at the time of agreement and is also clearly shown on the payment button within the application.


The provider's offer regarding the stated price remains valid until it is changed, withdrawn, made unavailable, or replaced by a new price offer from the provider.


The user can also purchase a "Premium Account" subscription, whereby all paid services (except for consumer competition tournaments) are then available to the user directly and without additional separate charges. The subscription is automatically renewed every month and the user can also cancel it, thereby losing these benefits again. This can be done in the appstore/ google play by cancelling the subscription.


Within the Premium account, additional functionalities are made available to the user, such as global leaderboards and access to non-public content - articles, etc. The Premium account user can also play an unlimited number of main and side tournaments at the same time (A).


Delivery costs are not charged as the Services are provided to the User online, i.e. they are not delivered on any tangible medium. Costs incurred by the user when using remote means of communication in connection with the conclusion of the contract, in particular the cost of the internet connection, the cost of telephone calls, etc., shall be borne by the user.


The user shall be informed of the price, the method of payment and the payment conditions for each service before entering into a paid contractual relationship via the provider's application. The order form contains, in particular, information about the Service ordered or the selected tournament or competition, the user's identification data and the method of payment (hereinafter collectively referred to as the "order").


By clicking on the "I want to pay" button, the user confirms the offer to conclude a contract for the provision of paid Services. The User submits the Order by clicking on the "Pay" button. Immediately upon receipt of the order, the Provider will confirm receipt of the order to the User by email to the User's email address provided in the User's account.


The validity of the order is subject to the completion of all the necessary information required in the order form, as well as confirmation by the User that he/she has read these Terms and Conditions during the account registration process.


The contractual relationship between the Provider and the User is established by delivery of the confirmation of order acceptance (acceptance), which is sent by the Provider to the User by electronic mail to the User's electronic address specified in his/her user account. This is the moment when the contract is concluded.


All orders accepted by the Provider are binding. The User agrees to the use of means of distance communication for the conclusion of the contract.


In the event of an apparent technical error on the part of the Provider in the indication of the price of the Services on its website or during the ordering process, the Provider shall not be obliged to allow the User access to the web application and thus provide the Services to the User at the apparently erroneous price, even if the User has been sent confirmation of receipt of the order in accordance with these Terms and Conditions.


The Provider shall also confirm the User's acceptance of the offer by making the paid Services available to the User, i.e. in particular by allowing the User to actively participate in a tournament or other competition within the Web Application, at the earliest upon proper payment of the price for the Service to the Provider. Paid Services will not be made available to the User by the Provider until the price has been duly paid.


The method of payment of the purchase price will be by payment in the mobile application (Apple / Google pay). 


Personal and other input data entered by the user into the internet banking system is protected by the payment gateways of the respective banks and is not passed on to third parties.


Payments can be made in the user's currency according to their location and phone settings.


The Provider's offer to provide the Services and their prices remain valid for as long as they are displayed on the Provider's website. Any Provider's offers posted on the Provider's website are not binding and the Provider is not obligated to enter into a contract with respect to the Service or credit if it has reason to do so. Such reason will be deemed to include, but not be limited to, if the Service has been withdrawn from circulation or the price of the Service has changed significantly. In such cases, the Provider reserves the right to cancel the order or part of it, or to withdraw from the contract already concluded, with the obligation to refund the User the respective amounts paid.


7. TECHNICAL PREREQUISITES FOR THE SERVICES PROVIDED

The User understands that in order to properly start and use the Services, it is necessary to meet the technical requirements on his/her part, as the functionality of the Services, or the web application, may be limited, especially in the case of the use of non-updated software.

The User acknowledges that in order to use the Services or the web application smoothly, the User's technical equipment must meet the following requirements:

a) The device has a browser installed that supports javascript and cascading stylesheets 3.
b) The device supports the standard https protocol
c) The mobile application installed to the device with Android (min v11) or iOS (min v14) to make the payment via the application store


The User is obliged to test, before paying the price for the Services, whether access to the Provider's web application works with his technical equipment (hardware and software) and the Internet connection used. By paying the price, the User confirms that the access to the Provider's web application works without problems. The Provider shall be entitled to reject a subsequent claim by the User on this ground of prior testing of the technical equipment for the provision of the Services.


8. PRICE OF SERVICES AND PAYMENT TERMS

The price of the Services or credit indicated on the Provider's website and in the order form at the time of sending this order (hereinafter referred to as the "Price") shall be valid for the order.
The prices listed on the Provider's website are subject to change from time to time. The Price is inclusive of the applicable VAT rate if the Provider is liable for VAT.

The price of the Services or ordered credit may be paid by the User by cashless online payment through the application store (GooglePay or ApplePay).


9. MAKING THE SERVICE AVAILABLE

The services provided to the User will be made available exclusively through the Provider's web application and the User's created account. The User acknowledges that the Service provided by the Provider will not result in the delivery to the User of any tangible medium, intangible work or other similar performance. The Service will be provided by the Provider exclusively through the Provider's web application, whereby the data from the web application relating to the User, his/her tickets and statistics will not be made available to the User in any other form, in particular on a tangible medium, by e-mail or in any other similar manner.

If the User complies with all the rules set out in these Terms and Conditions, the User will be allowed to use the Service via the Provider's web application for personal, non-commercial purposes only.

The User expressly acknowledges that the Provider has the right to terminate or restrict the User's access to the Provider's web application, as well as to cancel or block the User's account, at any time, without prior notice, without giving any reason and without any claim on the part of the User, in particular in the event that the User commits a serious breach of these Terms and Conditions, commits a violation of any applicable law relating to the provision of the Services, attempts any manipulation or fraudulent conduct in relation to tournaments, matches or the web application or commits any other unlawful or immoral act against the Provider or other users.

The Provider may suspend the provision of the Service or the Web Application for the necessary period of time for technical reasons to correct any problems caused, maintenance or testing or updates. The Provider is therefore entitled to modify, suspend or stop (permanently or temporarily) the provision of the Service or any part thereof.


10. INTELLECTUAL PROPERTY RIGHTS

The Services and the Provider's web application, as well as its content, are the property of Roombet s.r.o. or Roombet s.r.o.'s licensors, since the User does not acquire any ownership rights to the Services, web application or any other items on the basis of the concluded agreement with the Provider. All trademarks, service marks, trade names, logos, domain names and all other elements of the Provider's brand are the sole property of the Provider or persons with whom it cooperates under proper legal title.
These terms and conditions do not grant the user any rights to use the elements, marks or trade name of the provider, whether for commercial or non-commercial purposes.

The services provided by the Provider, as well as any statistical data included in this Service, are intended for the personal use of the User only. The User is prohibited from distributing, copying, modifying or otherwise technically processing the web application, its design, operation or other information without the verifiable written consent of the Provider.

The services made available by the provider to the user via the web interface are subject to legal protection under copyright law. Any dissemination or provision to third parties without the consent of the provider is prohibited. The user shall be liable to the provider for any damage caused by the infringement of copyright protection rights, in particular the user may be obliged to compensate the provider for any damage caused.

All content of the Services provided through the Provider's web application is protected in accordance with the legal regulations concerning copyright and other intellectual property rights, and the Provider is the exclusive owner thereof. By making the Web Application available to the User, no authorization is granted in connection with the capture, display, reproduction and distribution of images, images and visual and audio recordings relating to the Web Application, its content, functioning or design, including their processing and inclusion in an audiovisual work or for other marketing purposes. Any such use is prohibited without the written and prior consent of the provider.


11. WITHDRAWAL FROM THE CONTRACT

The User, who is a consumer, hereby expressly requests and agrees, in accordance with the provisions of Section 1823 CC, that the Provider make the paid Services available to the User before the expiry of the withdrawal period, i.e. the User expressly requests that the Provider commence performance of its obligations under the concluded contract within the withdrawal period. Access to the Services by the Provider shall take place no later than 12 hours after the price has been credited to the Provider's account or to the account of the payment gateway.

If the User is provided with the Services within the withdrawal period or is allowed to actively participate in the selected tournaments or competitions, the User shall not have the right to withdraw from the contract in this way. This fact has been brought to the user's attention as it is explicitly implied by the provisions of Section 1837(a) CC, which excludes the user's right to withdraw from the contract without giving a reason in this case.

The costs of the means of distance communication on the part of the user shall be borne by the user.


12. DISCLAIMER

The Provider's services are for entertainment statistical purposes only, whereby its provision does not promote or otherwise organize gambling, betting or other competitions. The information that will be evaluated through the web application may not be completely correct in all cases, the provider is not responsible in any way for the success or failure of the user in using the web application. By accepting these terms and conditions, the user acknowledges the above and declares that he/she will not claim any damages, injuries or claims from the provider in this regard.

The Provider shall not be liable to the User or have any obligation to refund the price paid in connection with interruptions of the Internet or other services or in connection with failures caused by the intervention of public authorities, other third parties or events beyond the Provider's control.


13. DELIVERY

The Parties may deliver all written correspondence to each other by electronic mail or other written means.

The User is entitled to deliver correspondence to the Provider at the email address specified in these Terms and Conditions or on the Provider's website. The Provider shall deliver correspondence to the Customer at the e-mail address specified in the User's account.


14. PROCESSING AND PROTECTION OF PERSONAL DATA

The manner in which the Provider processes the User's personal data is set out in the Privacy Policy section available on the Provider's website. The User acknowledges that he/she is obliged to provide his/her personal data correctly and truthfully and that he/she is obliged to inform the Provider without undue delay of any changes to his/her personal data.

The Provider uses cookies in order to monitor the preferences of visitors and to optimally design the website accordingly. The user agrees to the storage of so-called cookies on his computer. This leads to easier navigation and ensures a high level of user comfort of the website.

The user can deactivate the use of cookies in his/her internet browser if the performance of the contract is possible without storing cookies on the user's computer.


15. OUT-OF-COURT DISPUTE RESOLUTION

In the event that a consumer dispute arises between the provider and the user arising from the contract, which cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement of such a dispute to the designated body for out-of-court settlement of consumer disputes, which is the Czech Trade Inspection Authority.

The European Consumer Centre Czech Republic, located at Štěpánská 567/15, 120 00 Prague 2, Internet address: http://www.evropskyspotrebitel.cz is the contact point under Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on online dispute resolution for consumer disputes).


16. FINAL PROVISIONS

The Privacy Policy, which is available on the Provider's website, forms an integral part of these Terms and Conditions.

The Provider shall not be liable for any damage resulting from the provision of the Services or the use of the content published on the Provider's website. All content on the Provider's website is protected by copyright law.

If the relationship related to the use of the website or the legal relationship established by the contract contains an international (foreign) element, then the parties agree that the relationship is governed by Czech law. This is without prejudice to the user's rights under generally binding legal regulations. By choosing the law according to this article of the terms and conditions, the user in the position of a consumer is not deprived of the protection provided by the provisions of the legal system, which cannot be derogated from by contract.

If any provision of the Terms and Conditions is or becomes invalid or ineffective, the invalid provision shall be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision shall not affect the validity of the other provisions. Amendments and supplements to the contract or the terms and conditions shall be in writing, unless otherwise specified in the contract or the terms and conditions.

The contract, including the terms and conditions, shall be archived by the provider in electronic form. A model withdrawal form is annexed to the terms and conditions.

The Provider is entitled to unilaterally change the Terms and Conditions. The Provider is obliged to publish the new version.

These Terms and Conditions shall come into force and effect from 1.6.2025
